DECISION A MAJOR VICTORY FOR WHISTLEBLOWERS – ANTI-QUACK ADVOCATE DR TERRY POLEVOY VINDICATED

University of Calgary psychologist, Dr. Bonnie Kaplan, appealed to the Ontario Health Professions Appeal and Review Board (HPARB) against a decision by the College of Physicians and Surgeons of Ontario who twice dismissed her complaints against Ontario physician and anti-quack advocate, Dr. Terry Polevoy, for criticizing her research. HPARB ruled that the decision by the college to dismiss Kaplan’s complaints against Polevoy as “frivolous, vexatious, made in bad faith or otherwise an abuse of process” was, in their words “reasonable”.

This must be the first time that a researcher has filed harassment charges against a doctor and his colleagues for criticizing research.

Kaplan is well known for her investigations into a vitamin/mineral product banned in Canada but which she was using in research as a possible cure for bipolar disorder and other psychiatric conditions. One completed study by her into the use of this compound for fibromyalgia found it was of no value for that disorder.

Her initial research into bipolar disorder was halted by Health Canada. The Alberta offices of the vitamin company were raided by Health Canada and the Royal Canadian Mounted Police and charges were laid against the company. Dr. Kaplan testified for the company at their trial in Calgary but no verdict has yet been reached.

The complaint that Kaplan filed alleged that Dr. Polevoy and his two associates (Marvin Ross and Ron Reinhold) systematically harassed her and her colleagues by filing frivolous complaints and maligning her reputation. Kaplan’s formal complaint was directed against Polevoy as he is a physician and subject to discipline by his College. His two colleagues were co-authors of the e-book, Pig Pills Inc, which was critical of the Calgary research.

Kaplan also named Reinhold in her complaints claiming that “on June 11, 2002 she was stalked at Alberta Children’s Hospital by Ron Reinhold, security was called and he left the grounds”. HPARB found that this allegation by Dr. Kaplan “appear to have no bearing on the allegations against Dr. Polevoy”.
